AquaBalance β€” Terms of Use

27 October 2026
The Russian version of these Terms prevails in case of discrepancy.

Effective date: 27 October 2026
Version: 1.0

1. Who we are and what these Terms cover

1.1. The AquaBalance app (the "App") is developed and provided by Denis Zolotar (Denis Air Tech) ("we", "us", the "Developer"). Contact: daletmizug@gmail.com.

1.2. These Terms of Use (the "Terms") govern your use of the App, including its free features and the paid AquaBalance PRO subscription ("PRO").

1.3. By installing the App, ticking the consent boxes on the first-launch screen, or continuing to use the App, you confirm that you have read and accept these Terms and the Privacy Policy. If you do not agree, do not use the App and uninstall it.

2. Intended purpose: general wellness only

2.1. Purpose. The App is intended solely to support a healthy lifestyle: it helps you log the water you drink, set a personal approximate water goal, receive reminders and export your own records.

2.2. The App is NOT a medical device and is not registered, cleared or certified as a medical device in any jurisdiction (including Israel, the European Union and the United States).

2.3. The App does NOT provide medical advice. It is not intended to diagnose, treat, cure, mitigate, monitor or prevent any disease or condition, does not replace consultation with a physician or other qualified healthcare professional, and must not be used to make medical decisions.

2.4. Approximate goal. The daily goal calculated from weight, activity level and (optionally) a manual heat adjustment is a general estimate based on common general guidance for healthy adults. It does not take into account your health, medications, diet or other individual factors and may not be suitable for you.

2.5. The "Special situations" section (pregnancy and breastfeeding; "Increased fluid intake (on doctor's advice)"; "Weak sense of thirst") is informational and organisational only. The App does not calculate medical targets for these situations. If your doctor has prescribed a specific fluid amount (higher or lower than usual), enter the value given by your doctor and follow your doctor's instructions, not the App.

2.6. If you have heart, kidney or liver disease, a fluid restriction, a risk of hyponatremia, take diuretics or other medicines affecting fluid/electrolyte balance, or are pregnant or breastfeeding, consult your doctor before changing how much you drink.

2.7. Emergencies. The App is not for emergencies. If you feel unwell, seek medical help immediately (Israel: 101 Magen David Adom; EU: 112; US: 911).

2.8. Drinking too much water in a short time can be dangerous (overhydration / hyponatremia). Do not try to "catch up" with your goal by drinking large amounts at once.

3. Age and eligibility

3.1. The App is intended only for users aged 18 or over. By accepting these Terms you confirm that you are 18 or older.

3.2. Persons under 18 must not use the App or purchase PRO. The App is not directed to children or minors, including within the meaning of the US COPPA. If you believe a person under 18 is using the App, please contact us.

4. Licence

4.1. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for personal, non-commercial purposes.

4.2. You must not: (a) copy, modify, decompile, disassemble or attempt to derive the source code of the App, except as expressly permitted by law; (b) circumvent licensing or subscription mechanisms; (c) distribute, rent or sublicense the App; (d) use the App unlawfully; (e) remove copyright or trademark notices.

4.3. The Google Play Terms of Service also apply. In case of conflict, these Terms govern the relationship between you and the Developer, unless Google Play rules or the law require otherwise.

5. AquaBalance PRO subscription

5.1. Purchase via Google Play. PRO is sold only through Google Play Billing. Payment is processed by Google; we do not receive or store your payment card details. The price, currency, billing period (e.g. monthly or yearly), taxes and any free-trial terms are shown on the subscription screen and in Google Play before you confirm the purchase.

5.2. Auto-renewal. The subscription renews automatically at the end of each billing period at the then-current price until you cancel it. Payment is charged to the payment method linked to your Google Play account.

5.3. Free trial / introductory offer (if offered). Its duration, contents and the price after it ends are shown before you subscribe. Unless you cancel before the trial ends, it automatically converts to a paid subscription at the stated price.

5.4. How to cancel. You can cancel at any time: Google Play β†’ profile icon β†’ "Payments & subscriptions" β†’ "Subscriptions" β†’ AquaBalance β†’ "Cancel subscription", or via the "Manage subscription" link in the App's settings. Uninstalling the App does not cancel your subscription. After cancellation you keep PRO until the end of the period already paid for; no further charges are made.

5.5. Price changes. You will be notified of any price change through Google Play in the manner and timeframes set by Google Play and applicable law. If you do not agree, you can cancel before the new price takes effect.

5.6. Refunds. Refunds are handled under Google Play's refund policy. You may request a refund from Google and may also email us at daletmizug@gmail.com β€” we will review your request and help where Google Play's tools allow.

5.7. Your statutory rights are not affected. Nothing in these Terms limits rights you have under mandatory consumer-protection law in your country of residence, including:

5.8. What PRO includes. PRO features are listed on the subscription screen. We may improve and change features but will not materially reduce paid features during a period already paid for without a lawful reason; if that happens you may cancel and, where the law gives you that right, obtain a proportionate refund.

6. Your data

6.1. The App works without accounts and without ads. Your records (water, weight, settings, selected "special situations") are stored only on your device. We have no access to them.

6.2. See the Privacy Policy for details, including: writing water data to Health Connect (write-only, only with your permission), notifications, and Android backup (disabled in the App: data is not copied to cloud backup or transferred to another device). The App does not request or transmit location or weather data.

6.3. You are responsible for keeping your data. Uninstalling the App, resetting your device or clearing app data may permanently delete your records. Exported PDFs and data written to Health Connect or other apps are under your control and governed by those services' terms.

7. Third-party services

7.1. The App interacts with third-party services we do not control:

7.2. We are not responsible for the availability, accuracy or operation of third-party services (in particular Google Play and Health Connect).

8. Intellectual property

8.1. The App, its code, design, texts, graphics, icons, the AquaBalance name and logo are owned by Denis Zolotar (Denis Air Tech) or used under licence and are protected by intellectual-property laws. All rights not expressly granted to you are reserved.

8.2. The data you enter belongs to you.

8.3. Open-source components are licensed under their own licences (see "Legal β†’ Licences"). Google Play, Android and Health Connect are trademarks of Google LLC.

9. Disclaimer of warranties ("as is")

9.1. To the maximum extent permitted by law, the App is provided "as is" and "as available". We do not warrant that the App will be error-free or uninterrupted, or that calculations, reminders, exports or Health Connect sync will be accurate, timely or suitable for you.

9.2. We make no promise of any health outcome.

9.3. This does not limit mandatory warranties and rights you have under the law of your country of residence (e.g. statutory conformity rights for digital content in the EU).

10. Limitation of liability

10.1. To the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental, special or consequential damages, loss of profits, loss of data, or any harm arising from relying on the App instead of consulting a healthcare professional.

10.2. To the maximum extent permitted by applicable law, the Developer's total liability for all claims relating to the App is limited to the amount you actually paid for PRO in the 12 months before the event giving rise to the claim or, if you paid nothing, ILS 100 (one hundred new Israeli shekels) or its equivalent.

10.3. Exceptions. Nothing in these Terms excludes or limits the Developer's liability:

10.4. Some jurisdictions (including some US states) do not allow the exclusion of implied warranties or limitation of liability; in that case the relevant provisions apply to you only to the extent permitted.

11. Indemnity

To the extent permitted by law, and except where you act as a consumer and such a clause is prohibited, you agree to indemnify the Developer for losses arising from your breach of these Terms or unlawful use of the App.

12. Termination

12.1. You may stop using the App at any time by uninstalling it (and cancelling your subscription in Google Play).

12.2. We may suspend or discontinue the App or any feature. If we discontinue PRO during a paid period, we will seek to provide a proportionate refund via Google Play or as otherwise required by law.

12.3. Provisions that by their nature should survive (Sections 8–11 and 13–15) survive termination.

13. Governing law and jurisdiction

13.1. These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply.

13.2. The competent courts of the Tel Aviv-Jaffa district, Israel, have exclusive jurisdiction.

13.3. Consumer protection. If you are a consumer residing outside Israel (in particular in the EU/EEA, UK or US), this choice of Israeli law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your place of residence where applicable law so provides.

13.4. EU consumers may also use out-of-court dispute-resolution bodies available in their country.

13.5. Before going to court, please email us at daletmizug@gmail.com β€” we will try to resolve the matter within 30 days.

14. Changes to these Terms

14.1. We may update these Terms, e.g. when App features or legal requirements change. The new version is published at the Terms link and in the App with its effective date.

14.2. We will notify you in the App of material changes in advance β€” at least 14 days (unless an immediate change is required by law) β€” and, where required, ask you to accept them again. If you do not agree, stop using the App and cancel your subscription. Changes are not retroactive and do not change the price of a period already paid for.

15. General

15.1. If any provision is held invalid, the remaining provisions remain in force.
15.2. Failure to enforce a right is not a waiver.
15.3. You may not assign your rights under these Terms without our consent; we may assign them to a successor with notice to you, without reducing your rights.
15.4. These Terms are provided in English, Russian and Hebrew. In case of discrepancy, the Russian version prevails; any ambiguity is construed in the consumer's favour.
